A Gering man has been accused of sexually assaulting three individuals, including a child between the ages of 12 and 16.
Two counts of first-degree sexual assault of an incompetent person, a Class II felony, and first-degree sexual assault of a child, a Class IB felony, were filed Wednesday against Bacilio Palomo Sr., 38, of Gering.
An arrest affidavit details that a Scottsbluff Police investigator followed up in February on a report originated with another officer. The officer had taken a report in January in which a woman alleged that she had been raped in 1998.
The woman told police that she had stayed overnight and been involved in sexual relations with another man in July or August. When she awoke later that night, she said she felt someone on top of her. She attempted to push the individual off her, but he held her by the shoulders. She told police that the man raped her, while she screamed and attempted to fight the man, who she identified as Palomo. She said that the man she had stayed with woke and pursued the man.
Police questioned the man, who told police that he remembered the incident, saw the man on top of the woman and chased him out of his home. Other witnesses were questioned and were aware of the incident, including a woman who said she recalled seeing Palomo pulling up his pants and running out of the room. Another woman witnessed Palomo with the woman, but said she was unsure if the sex had been consensual but that the woman could have been passed out from alcohol consumption.
During the investigation, police contacted an individual after concerns were expressed that the woman may have been assaulted by Palomo as a child. The woman alleged that she had been inappropriately touched as a child, but she did not like talking about it because she had experienced harassment by family members. The woman disclosed two incidents in which she alleged Palomo had sexually assaulted her. The investigator believed that the assaults occurred in 1996 or 1997.
Palomo is also charged with assaulting a third individual, a child between the ages of 12 and 16, allegedly assaulted between the periods of January 2011 and January 2012, but additional details were not available in the affidavit.
Palomo is being held on a $250,000 bond in the Scotts Bluff County Detention Center. He was arraigned on the charges Friday in Scotts Bluff County Court.
